After having studied the case laws, it is necessary to also study the definition of Rape as given in the Indian Penal Code, 1860. As per Section.375 of IPC a man is said to commit the offence of rape with a woman under the following six circumstances:
- Sexual intercourse against the victims will,
- Without the victims consent,
- With her consent, when her consent has been obtained by putting her or any person that she may be interested in fear of death or hurt,
- With her consent, when the man knows that he is not her husband,
- With her consent, when at the time of giving such consent she was intoxicated, or is suffering from unsoundness of mind and does not understand the nature and consequences of that to which she gives consent,
- With or without her consent when she is under sixteen years of age.

i was surprised by that point too! stupid! pls. let me know if you come across that damned reason why that qualifies as rape if there's one. infact a woman can misuse this point very easily. (although our tamil cinema sentiment says she won't do that) also, from the law's standpoint why is it wrong to have sex before marriage? (each person can have his own ethics but why does it become law)

Point 4, as is stated here, is incomplete. It reads this way:
"... with her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is lawfully married, or"
